Terms of Service

Effective Date: March 8, 2026

These Terms of Service ("Terms") govern your access to and use of the Invisihome website, mobile application, and related services (collectively, the "Platform") operated by Invisihome, LLC ("Invisihome," "Company," "we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.

1. Description of the Platform

Invisihome provides a digital platform designed to connect property owners, buyers, investors, and real estate professionals to discover, analyze, and potentially transact in real estate opportunities.

The Platform may allow users to:

  • Submit property information
  • Discover off-market properties
  • Analyze property data
  • Communicate with buyers or sellers
  • Access potential real estate opportunities
  • Facilitate potential real estate transactions

Invisihome does not guarantee that any transaction will occur.

2. No Brokerage Relationship

Unless explicitly stated in a separate written agreement with a licensed brokerage, Invisihome is not acting as a real estate broker, agent, fiduciary, or advisor.

Invisihome does not:

  • Provide real estate brokerage services
  • Provide legal advice
  • Provide financial advice
  • Provide tax advice
  • Participate in negotiations between buyers and sellers
  • Represent any party in a real estate transaction
  • Act as a broker, agent, or intermediary
  • Handle escrow, closing, or transfer of property ownership

Users are responsible for obtaining their own professional advisors.

Certain services may be provided by licensed professionals operating independently from the Platform.

All transactions occur directly between users or through licensed third-party professionals such as brokers, title companies, or attorneys.

Users are solely responsible for conducting due diligence and completing any real estate transaction.

3. Eligibility

You must be 18 years or older to use the Platform.

By using the Platform you represent that:

  • You have legal capacity to enter contracts
  • All information provided is accurate
  • You will comply with applicable laws

4. User Accounts

Users may be required to create an account.

You agree to:

  • Provide accurate registration information
  • Maintain the confidentiality of login credentials
  • Be responsible for all activity on your account

Invisihome may suspend or terminate accounts at its discretion.

5. Property Listings and Information

Property data on the Platform may originate from:

  • Public property records
  • Third-party databases
  • User-submitted information
  • Automated data sources

Invisihome does not guarantee the accuracy, completeness, or reliability of property information.

Users must independently verify:

  • Property ownership
  • Property condition
  • Zoning compliance
  • Square footage
  • Permits and legal status

Real estate transactions involve risk and users should conduct proper due diligence.

6. Platform Fees

Invisihome may charge fees for certain services provided through the Platform.

These may include:

  • Buyer access fees
  • Platform transaction fees
  • Listing service fees
  • Marketplace access fees
  • Data access fees

Fees may be disclosed before completing a transaction or service.

Unless required by law, all fees are non-refundable.

6.1 Non-Circumvention and Platform Fee Protection

Users acknowledge that the Platform facilitates introductions, communications, and opportunities between property owners, buyers, investors, and real estate professionals.

If a user identifies, contacts, or becomes aware of a property opportunity, seller, buyer, investor, or transaction through the Platform, such introduction shall be considered a "Platform Introduction."

Users agree that they will not directly or indirectly:

  • Circumvent the Platform
  • Attempt to avoid Platform fees
  • Complete transactions outside the Platform after a Platform Introduction
  • Use information obtained through the Platform to conduct off-platform transactions

This restriction applies for 24 months following the initial Platform Introduction.

6.2 Platform Fee Obligation

If a transaction occurs between parties introduced through the Platform, whether the transaction occurs:

  • On the Platform
  • Outside the Platform
  • Through a third party
  • Through a separate agreement

Invisihome shall remain entitled to its full applicable Platform fee.

6.3 Liquidated Damages

If a user circumvents the Platform and completes a transaction outside of the Platform following a Platform Introduction, the user agrees that Invisihome shall be entitled to liquidated damages equal to the greater of:

  • The applicable Platform fee that would have been charged
  • Five percent (5%) of the total transaction value

The parties agree this amount represents a reasonable estimate of damages resulting from circumvention.

7. User Conduct

Users agree not to:

  • Provide false property information
  • Misrepresent ownership or authority
  • Engage in fraudulent activity
  • Harass or abuse other users
  • Violate any applicable laws or regulations
  • Use automated systems, bots, or scraping tools to access or collect Platform data
  • Attempt to reverse engineer or access the Platform's underlying software or systems
  • Interfere with the security, integrity, or performance of the Platform
  • Access accounts or data belonging to other users without authorization
  • Use the Platform for unlawful purposes or to violate applicable laws
  • Copy, reproduce, distribute, or commercially exploit Platform data without permission

Invisihome reserves the right to suspend or terminate accounts engaging in prohibited uses.

8. Third-Party Services

The Platform may integrate with third-party providers including:

  • Title companies
  • Escrow companies
  • Payment processors
  • Data providers
  • Real estate professionals

Invisihome is not responsible for the services or conduct of third parties.

9. Intellectual Property

All Platform content including but not limited to:

  • Software
  • Algorithms
  • Databases
  • Designs
  • Logos
  • Branding
  • Graphics

are the exclusive property of Invisihome.

Users may not reproduce, distribute, reverse engineer, or create derivative works from Platform content without written permission.

10. Platform Availability

Invisihome does not guarantee uninterrupted or error-free access to the Platform.

We may modify, suspend, or discontinue services at any time.

11. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE."

Invisihome disclaims all warranties including:

  • Merchantability
  • Fitness for a particular purpose
  • Accuracy of property data
  • Reliability of services

Use of the Platform is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Invisihome shall not be liable for:

  • Losses from real estate transactions
  • Property defects or undisclosed conditions
  • Financial investment losses
  • Data inaccuracies
  • Actions of other users

In no event shall Invisihome's total liability exceed the greater of:

  • $100
  • Fees paid to the Platform

13. Indemnification

You agree to indemnify and hold harmless Invisihome and its affiliates, officers, employees, and partners from claims or damages arising from:

  • Your use of the Platform
  • Transactions you enter into
  • Violations of these Terms

14. Termination

Invisihome may suspend or terminate user access at any time if:

  • These Terms are violated
  • Fraudulent activity is suspected
  • Platform security is threatened

15. Governing Law

These Terms are governed by the laws of the State of California.

Any disputes shall be resolved in courts located in California.

16. Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in the State of California in accordance with the rules of the American Arbitration Association.

17. Modifications to Terms

Invisihome may update these Terms periodically.

Continued use of the Platform constitutes acceptance of updated Terms.

18. Class Action Waiver

Users agree that any disputes shall be resolved individually and not as part of a class action, collective action, or representative proceeding.

User Content License

By submitting property information, listings, or other content to the Platform, users grant Invisihome a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with operating the Platform.

Electronic Communications

By using the Platform, users consent to receive communications electronically including account notifications, transaction updates, and service messages.
